The NRA as you might guess has come out against the legislation calling it "draconian" in nature.
ASSAULT RIFLES
To classify a weapon as an assault rifle, where there had been a two point test there is now one - either muzzle flash suppressor OR a removable magazine. Supposedly any gun meeting these criteria will be banned.
AMMUNITION
This is purported to be the "toughest" part of the new legislation...the regulating of the number of rounds a magazine can hold (for any gun) " New York will define a large capacity magazine as any that holds more than seven rounds, down from 10. Anyone owning a magazine that holds more than 10 rounds will be required to sell it out-of-state within a year". Is that last line really enforceable? The Magazine Division of the NYPD in the near future perhaps??
"In addition, gun sellers will be required to do a background check before selling ammunition, and residents will be required to buy ammunition through a licensed dealer. If a buyer makes a large purchase of ammo, the dealer is required to alert law enforcement officials."
GUN SALES
Guns sales will require background checks even sales between individuals (except for between family members). The law will also attempt to keep the mentally ill from buying weapons. All of this ought to be very interesting.
As you might imagine, the NRA will be at the forefront of the legal challenges to surely be coming.
Down the freeway Gov. Jack Markell (D) of Delaware is on a parallel course of action to ban all assault rifles, magazines holding more than 10 rounds and background checks on all sales.
Virgina and Jersey want mental health screening and home
More than half the states have some stirrings of the above. Traditional definition of a "dog pile" in action.
I am sure this will have some effect but just exactly what, I don't know.

On the other side of town the Obama Proposal is being touted as "sweeping gun control". Here is the meat and potatoes of the Obama-Biden offering:
Some of the main legislative proposals backed by Obama and Vice President Joe Biden are:
- requiring criminal background checks on all gun sales, including private sales
- banning "military-style" assault weapons
- limiting ammunition magazines to 10 rounds
- strengthening penalties for gun trafficking
There are also 23 "executive actions not subject to congressional scrutiny that include the CDC doing research on gun crime. And stronger prosecution if you fail a background check. What exactly does it take to fail a background check and what will you be prosecuted for?? This could be the scariest of all...and it doesn't have to go through Congress?? No wonder the shelves in many gun stores are almost empty now.

My friends if you thought some of the recent posts floating around were too doom and gloom. I invite you to click on the links to both these news articles. Read them carefully...out loud if necessary. Then think about what we really need to do and what they are trying to do. Getting any freedom limiting legislation through the channels is always easier when raw emotion is running high. I pray for common sense to grip the majority.
New York is already a done deal. Cuomo's goose-stepping was swift and sure.
The one silver lining of semi-rational thought (at least on the federal level) is many in the House see little chance of much of this coming to fruition...yet it plays well at the political gatherings. I guess that is win/win?
What are your thoughts on this early attempt at eliminating another Sandy Hook? Does the speed of New York's passage of law alarm you? Did you watch the video above? Thoughts?

The Virginia and Jersey laws are scary.
I find this very alarming. The President contradicted himself repeatedly. ::shocking:: "We can't change anything unless Congress and the American people demand it. Now let me sign these Executive Orders." And I loved how he used those kids as a human shield just in case anyone wanted to fire back. Very clever. And so par for the course. And invoking Ronald Reagan as a proponent for this new legislation would be laughable if it weren't insane. Anyone who is even remotely familiar with Reagan's idea's on gun control and the 2nd Amendment would know that he would never stand behind all of what Obama has in store for "We The People." When a 7-10 round magazine is considered High Capacity, we have crossed the line out of The Reagan Zone and strictly into Obamanation.
The President does have one thing right: everyone does need to be ringing the phone off the hook of their Senators and Congressman. They need to let them know that background checks are always smart. No one is arguing that point. Everything else is horse hockey. We The People Are Not Happy. Do we need to parade out our kids to make the point???

Robin: Yeah marching those kids out on stage and leading off with a Biden left hook to the Sandy Hook parents...really spooky stuff going on when so many so high up aren't thinking about the people but about who can get the most political mileage out of it.
Hey Chuck! I'd love to weigh in on this one and it will be a long one.
Although I'm a registered democrat, I always vote issue specific. I have guns. We are out in the middle of nowhere right now and are a few miles from the border. You can bet your bottom dollar that I'm armed.
If there is a primary, Cuomo will most likely be part of it, BUT if Biden wants the top job he'll be the Dem's candidate. Besides, Cuomo is a grandstanding jackass.
I want to yell at the TV every time they mention the term "assault weapon." For about 50 years, the one thing ALL "assault weapons" have in common, is that they have a full automatic option. NONE of the mass killings that are being mentioned on TV involved the use of a fully automatic assault rifle. They should stop saying that.
My state already has most of those restrictions in place. For example 10 round magazine capacity max, magazines have to be removed with a tool (such as a bullet, to push a recessed release).
Crazy people will always find something to kill people with, so whatever they do, isn't going to stop that. Why did it take Sandy Hook to bring this to a head? Hundreds of people have died in the past year or so in Chicago, because of an out of control gang wars. Why didn't everyone scream about this? We all know the answer...
The tiny little .22 caliber bullet kills far more people each year in this country. Why aren't they calling for a ban on them?
99.99999% of people who legally own guns never kill anyone with them. This ban won't prevent a darn thing.
Okay, having said that. I don't think ANYONE NEEDS a magazine with more than 10 rounds in it. I don't think anyone NEEDS an assault type rifle.
But, what if they want those things? Better yet, what if they are a law abiding citizen who can pass the background check and want those things? What in the world is wrong with them having them? Nothing...
The one thing I don't have any problem with, is the background check. Some people just shouldn't have weapons. Of course, they'll still be able to get them illegally.
We are currently in Southern Arizona and a lot of the locals I've seen are clearly carrying a handgun. Concealed, semi-concealed, or right out in the open. Guess what? They're acting just like ordinary people.
I want weapons just in case the SHTF. Zombies, invasions, home protection, etc. Just about everyone should have the right to do those things.
There is however, one group of people I think shouldn't have guns at all. They are the right wing, white trash, whack jobs, who believe they need to have every weapon they can get their hands on, to protect themselves from their own government. That is just crazy! Anyway, I really don't expect much to change...
I don't know if any of this made any sense at all, but my rant is complete!
This is exactly why I didn't think discussing gun control at this point was a good idea. Every reaction is knee jerk. I'd like the economy/debt worked on before this.

I like how people are willing have our freedoms stripped away because they are incapable of making decisions on their own. The 2nd Amendment wasn't imposed so that people could protect themselves from one another or go hunting for squirrels, it was written so that people could protect themselves from a government that tries to restrict their freedoms (which it's very well doing right now). Once the government has stripped us of all our defenses, they will no longer have anything to fear from the people. They will finally hold complete control over us. (Sorry, I'm a bit of a conspiracy theorist, so I hold this to be true). It's also scary how quickly Sandy Hook has been turned into an example. These politicians are so out of touch with reality that they are incapable of gauging simple human emotion. Blah, sorry for the long windedness.
Well, Chuck, I'm a proud Democratic - as you may know. I've argued with several people on this issue, and it's so tricky and emotional that I prefer to not delve in too deep. I generally think the laws are a step in the right direction but probably will not make a bit of difference.
I believe that now I (as a clinical social worker) am required to report potentially dangerous clients to "government authorities." What a joke! All of my clients are potentially dangerous. What gov't authorities do I go to, and what the heck will they do about it? Oy, you got me started.
I'll stop now.

Pat: Yeah Cal has some strict laws. That whole assault rifle thing is just crazy. I saw on the news today that Groupon had been offering a discount deal for CHP training and then the company pulled it and all offers having to do with guns to "re-evaluate their position on this". What a load of crap.
Shannon: Totally my concern on this. It is pure politics at this point and shameful politics at that.
